Terms and Conditions of Use
Right of Withdrawal
In accordance with art. 52 of Italian Legislative Decree 206/2005 and article 9 of DIRECTIVE 2011/83/EU OF THE EUROPEAN PARLIAMENT AND COUNCIL, under the right of withdrawal the Consumer has fourteen (14) calendar days from the day of receipt of the product(s) to return any unwanted or unneeded product(s).
To exercise the right of withdrawal, the Consumer must inform ELECTRONIC MELODY FL 3 of their decision to withdraw from the contract, and then request the opening of a WITHDRAWAL return case with an explicit declaration by email to info@elettroking.com, indicating: the date of purchase, the order number and their bank details.
The Consumer may request a replacement with another item or a refund, which will be made by bank transfer or, where possible, using the same payment method. ELECTRONIC MELODY FL 3 has fourteen (14) calendar days from receipt of the product(s) to issue the refund. ELECTRONIC MELODY FL 3 will arrange collection of the goods; the shipping costs to return the product are borne by the Consumer and are non-refundable, and correspond to the same amount paid for the delivery of the product at the time of purchase.
The Consumer has fourteen (14) calendar days to inform ELECTRONIC MELODY FL 3 that they wish to exercise the right of withdrawal and to obtain a withdrawal return number from Customer Service.
Please note: The Consumer must arrange collection of the goods and communicate it to the email address info@elettroking.com no later than 14 days from the date on which they communicated their decision to exercise the right of withdrawal (article 14, paragraph 1 of DIRECTIVE 2011/83/EU OF THE EUROPEAN PARLIAMENT AND COUNCIL).
The refund will be made using the same payment method with which the Consumer paid the initial transaction (article 13, paragraph 1 of DIRECTIVE 2011/83/EU OF THE EUROPEAN PARLIAMENT AND COUNCIL). ELECTRONIC MELODY FL 3 may withhold the refund until the goods are received (article 13, paragraph 3 of DIRECTIVE 2011/83/EU OF THE EUROPEAN PARLIAMENT AND COUNCIL).
Important note: the right of withdrawal does not apply to an item that is no longer suitable to be put back on sale as new; in the case of products fitted with warranty seals, these seals must remain intact.
The item must be returned with all of its accessories (manuals, cables, chargers, warranties, etc.).
If these conditions are not met, the item will be returned to the Consumer at their own expense.
Article 47 of DIRECTIVE 2011/83/EU states the following:
Some consumers exercise their right of withdrawal after having used the goods to an extent more than necessary to establish their nature, characteristics and functioning. In this case the consumer should not lose the right of withdrawal but should be liable for any diminished value of the goods. In order to establish the nature, characteristics and functioning of the goods, the consumer should only handle and inspect them in the same manner as they would be allowed to do in a shop. For example, the consumer should only try on a garment and should not be allowed to wear it. Therefore, during the withdrawal period, the consumer should handle and inspect the goods with due care.
Therefore, ELECTRONIC MELODY FL 3 may apply penalties in the event of a loss of value of the item caused by handling other than that necessary to establish its nature, characteristics and functioning. Following the unquestionable assessment of ELECTRONIC MELODY FL 3, this penalty may be set at a maximum of 50% of the value of the goods for which withdrawal is requested.
For correct handling of the return, the Consumer must always indicate the order reference number and their complete contact details.
After receiving and accepting the parcel, and depending on the nature of the item, the available stock and the Consumer's wishes, the After-Sales service of ELECTRONIC MELODY FL 3 will offer to exchange the item with a similar one or one of equivalent value.
Otherwise, ELECTRONIC MELODY FL 3 will issue the refund using the same payment method as the initial transaction, unless the Consumer has expressly agreed otherwise; in any case, the Consumer shall not incur any cost as a result of such refund. The refund will correspond to the order total (item(s) + shipping costs, if the order consists of a single item or if all items in the order are returned).
ELECTRONIC MELODY FL 3 reserves the right, at its own discretion, to withhold from the refund the amount for any used, damaged or incomplete products (plug adapter supplied for items whose power supply is not of European type, styluses, missing memory cards… non-exhaustive list).
Return Costs Related to the Right of Withdrawal
In the event of withdrawal, the shipping costs are borne by the Consumer.
ELECTRONIC MELODY FL 3 accepts orders only with delivery within Italian territory.
Orders, Invoicing and Conclusion of the Contract
For every order placed, ELECTRONIC MELODY FL 3 issues an invoice for the shipped goods by email to the order holder, pursuant to art. 14 of Presidential Decree 445/00 and Legislative Decree 52/2004. The data provided by the customer at the time of the order will be entered on the invoice.
No change will be possible after the invoice has been issued. The customer may purchase the products present in the electronic catalogue of ELECTRONIC MELODY FL 3 at the time the order is sent. The images and technical data accompanying a product sheet may not be complete or exhaustive of the product's own characteristics, and may differ for example in: (weight, colour, etc.).
The wording "available" shown for a product is purely indicative, given the possibility of multiple purchases at the same instant by several users. For this reason, once the order has been received, ELECTRONIC MELODY FL 3 reserves the right to verify the availability of the goods and, if unavailable, to promptly communicate the non-acceptance of the order. No liability may be attributed to ELECTRONIC MELODY FL 3. The correct receipt of the order is confirmed by ELECTRONIC MELODY FL 3 by means of a reply by email, sent to the email address provided by the customer.
This confirmation message will repeat all the data entered by the customer, who undertakes to verify its correctness and to promptly communicate any corrections. Subsequently, having verified the availability of the goods and the accuracy of the customer's data, ELECTRONIC MELODY FL 3 will send acceptance of the contract by email. The contract concluded between the customer and ELECTRONIC MELODY FL 3 is to be considered concluded only after ELECTRONIC MELODY FL 3 sends the contract acceptance email.
By placing an order on the ELECTRONIC MELODY FL 3 website, the customer declares that they have read the conditions of sale, the payment methods offered and the entire purchase procedure. With express reference to art. 3 and 4 of Legislative Decree 185/89, the customer will receive, by email, all the information necessary to identify the seller, which the customer must keep together with the contract acceptance email.
